1. Introduction and Acceptance
Welcome to The Right Choice Air Conditioning, Heating & Plumbing (“The Right Choice HVAC,” “The Right Choice Texas,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website located at therightchoicetexas.com (the “Website”), our services, and any communications — including SMS/text messages, email, and phone calls — that you receive from us.
By accessing or using our Website, requesting an estimate or service, signing a service agreement, opting in to SMS communications, or otherwise communicating with us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use our Website or services.
2. About Our Services
The Right Choice HVAC is a licensed Texas-based provider of residential and commercial heating, ventilation, air conditioning (HVAC), plumbing, indoor air quality, and related home and building services in the Dallas/Fort Worth Metroplex and surrounding areas. Our services include but are not limited to:
- Air conditioning installation, repair, replacement, and maintenance
- Heating and furnace installation, repair, replacement, and maintenance
- Ductless mini-split installation and service
- Plumbing service, repair, and water heater installation
- Indoor air quality services, duct cleaning, and air purification
- Preventive maintenance plans and system tune-ups
- Emergency service calls
- Light commercial HVAC and plumbing services
The specific scope, pricing, and terms of any service performed will be set out in a separate written estimate, work order, invoice, or service agreement (“Service Agreement”) provided to the customer. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement controls with respect to that specific job.
3. Estimates, Pricing, and Payment
3.1 Estimates
Estimates are provided based on the information available at the time of the visit and may include a service-call or diagnostic fee. Estimates are valid for thirty (30) days from the date issued unless otherwise stated. Final pricing may change if additional work, materials, or unforeseen conditions are discovered, and we will communicate any such changes to the customer for approval before performing the additional work.
3.2 Payment
Payment is due at the time of service unless other terms are agreed in writing. We accept cash, check, major credit cards, and approved financing. A returned-check fee may apply for any check that is returned for insufficient funds, in accordance with Texas law.
3.3 Credit Card Surcharge
In accordance with applicable law, The Right Choice HVAC may apply a surcharge of up to four percent (4%) on credit card transactions to offset the cost of card processing. The surcharge will be disclosed before payment is accepted. No surcharge is applied to debit card transactions or to cash, check, or ACH payments.
3.4 Late Payment
Invoices not paid by the due date may accrue interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted by Texas law. The customer is responsible for all reasonable collection costs, including attorney fees, incurred to collect overdue amounts.
3.5 Financing
We offer financing through approved third-party financing partners (such as Wisetack, Synchrony, Sunbit, or others). Financing terms, eligibility, and approval are determined solely by the financing partner. By applying for financing, you authorize us to share information needed to process the application with that partner. Financing partners have their own terms, privacy policies, and disclosures, which the customer should review carefully.
4. Scheduling, Cancellations, and No-Show Policy
4.1 Scheduling
Service appointments are scheduled in time windows that may vary based on technician availability, traffic, and prior service calls. While we make reasonable efforts to arrive within the scheduled window, exact arrival times cannot be guaranteed. We will notify you by phone, SMS (if you have opted in), or other agreed method if there are material changes to your scheduled window.
4.2 Cancellations and Reschedules
Customers may cancel or reschedule appointments by calling (214) 251-4015 at least four (4) hours before the scheduled time. Repeated cancellations or no-shows may result in a service fee or in our refusing to schedule future service.
4.3 Right to Decline Service
The Right Choice HVAC reserves the right to refuse, decline, or terminate service in our sole discretion, including for safety reasons, abusive or threatening conduct toward our staff, code violations or unsafe conditions at the property, non-payment, or any other lawful reason.
5. Customer Responsibilities and Property Access
The customer is responsible for:
- Providing safe, lawful, and reasonable access to the work area
- Ensuring authorized adults are present at the property when required
- Disclosing any known hazardous conditions, including but not limited to asbestos, mold, lead paint, hazardous chemicals, structural defects, pests, or aggressive animals
- Securing pets, valuables, and fragile items prior to our arrival
- Obtaining permission from the property owner if the customer is not the owner
- Securing any homeowner-association (HOA) or landlord approvals required for the work
- Providing adequate electricity, water, and other utilities needed to perform the work
The Right Choice HVAC is not responsible for delays, additional costs, or damage caused by the customer’s failure to fulfill these responsibilities.
6. Permits, Licensing, and Code Compliance
The Right Choice HVAC is licensed by the Texas Department of Licensing and Regulation (TDLR) for HVAC work and holds applicable plumbing licensure for plumbing services. We will obtain permits required by law for installations and major repairs. Permit fees, when applicable, are passed through to the customer at cost or as separately quoted. The customer authorizes us to act as their agent for the limited purpose of obtaining required permits.
7. Warranties
7.1 Workmanship Warranty
Unless otherwise stated in a written Service Agreement, The Right Choice HVAC warrants the workmanship of installations and repairs for a period of one (1) year from the date of completion. This warranty covers the labor required to correct defects in workmanship and does not cover the equipment itself, parts subject to manufacturer warranty, or damage caused by misuse, neglect, accidents, alterations by others, acts of God, or normal wear and tear.
7.2 Manufacturer Warranties
Equipment and parts are covered by the manufacturer’s warranty (if any), which is provided directly by the manufacturer and not by The Right Choice HVAC. Manufacturer warranties typically require timely registration and proper maintenance. The customer is responsible for registering equipment as required and for maintaining the equipment in accordance with the manufacturer’s instructions. Failure to register or to perform required maintenance may void the manufacturer warranty.
7.3 Maintenance Plan Coverage
If the customer purchases a maintenance plan, the specific coverage, exclusions, and obligations under that plan will be set out in the maintenance plan document, which controls in the event of any conflict with these Terms.
7.4 Disclaimer
EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH IN A WRITTEN SERVICE AGREEMENT OR MAINTENANCE PLAN, THE RIGHT CHOICE HVAC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE RIGHT CHOICE HVAC’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR ANY SERVICE PROVIDED SHALL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL THE RIGHT CHOICE HVAC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or violations of the Texas Deceptive Trade Practices–Consumer Protection Act (DTPA) where such limitations would be unenforceable.
9. Indemnification
To the maximum extent permitted by Texas law, the customer agrees to indemnify, defend, and hold harmless The Right Choice HVAC, its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of: (a) the customer’s breach of these Terms; (b) any false or incomplete disclosure of property conditions; (c) the customer’s violation of applicable law; or (d) injury or property damage caused by the customer’s negligence or willful misconduct.
10. SMS / Text Message Communications
Use of our SMS messaging program is governed by these Terms and by the SMS section of our Privacy Policy, which is incorporated by reference.
SMS Sending Number: SMS messages from The Right Choice HVAC are sent from our dedicated messaging number (945) 319-8660. You may reply with opt-out or help keywords directly to that number. For voice support, customer service, or to speak with a representative, please call our main business line at (214) 251-4015.
10.1 Voluntary Opt-In
Consent to receive SMS messages from The Right Choice HVAC is voluntary and is never required as a condition of purchasing any goods or receiving any services from us. Customers who do not opt in to SMS will receive the same level of service as those who do.
You may opt in by:
- Affirmatively checking a separate, unchecked SMS opt-in box on our Website service inquiry form;
- Verbally agreeing to receive SMS messages when speaking with our representatives at (214) 251-4015; or
- Initiating an inbound text message to our SMS number at (945) 319-8660 to begin a service inquiry, in which case you consent to related responses regarding that inquiry.
10.2 Message Types and Frequency
If you opt in, you may receive recurring automated text messages including appointment reminders and confirmations, technician dispatch and arrival updates, service completion follow-ups, estimate delivery and follow-ups, scheduling change notifications, billing or invoice notifications, account-related messages, and (if you have opted in to marketing messages) seasonal maintenance reminders and promotional offers. Message frequency varies based on your activity and service needs.
10.3 Message and Data Rates
Message and data rates may apply based on your wireless carrier plan. The Right Choice HVAC is not responsible for any charges your carrier may impose.
10.4 Opt-Out
You may opt out of receiving SMS messages from The Right Choice HVAC at any time by replying with any of the following keywords to any SMS we send: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT. Consistent with the Federal Communications Commission’s April 2025 TCPA opt-out rule, we will honor any reasonable indication that you wish to revoke consent. After receiving your opt-out request, we will send a single final confirmation message and will not send further SMS messages to your number unless you opt back in. You may also revoke consent by calling (214) 251-4015 or by emailing support@therightchoicetexas.com.

10.6 Mobile Information — Not Shared With Third Parties
The Right Choice HVAC does not share, sell, rent, lease, or otherwise transfer mobile phone numbers, SMS opt-in data, or SMS consent information to any third parties or affiliates for marketing or promotional purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. The only limited circumstances in which mobile information may be processed by a third party are described in our Privacy Policy (e.g., our SMS platform Twilio acting solely on our behalf, our CRM provider, or where required by law).
10.7 Eligibility
You must be at least eighteen (18) years of age and the regular user of the mobile number you provide, or have authority to consent on behalf of the regular user, to opt in to our SMS program.
10.8 Carriers and Service Disclaimers
Carriers (T-Mobile, AT&T, Verizon, US Cellular, and others) are not liable for delayed or undelivered messages. The Right Choice HVAC is not liable for any delay, failure, or interruption of message delivery caused by carrier networks, your device, or other factors outside our reasonable control.
11. Email and Other Electronic Communications
By providing your email address, you consent to receive transactional emails (such as appointment confirmations, invoices, receipts, and warranty information). You may receive marketing or promotional emails only if you separately opt in. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email. Marketing emails comply with the CAN-SPAM Act of 2003.
12. Use of Our Website
12.1 Permitted Use
You may use our Website to learn about our services, request estimates, schedule appointments, communicate with us, and access information we make available. You agree to use the Website only for lawful purposes and in compliance with these Terms.
12.2 Prohibited Conduct
You agree not to:
- Use the Website in any way that violates any applicable federal, state, or local law or regulation
- Submit false, inaccurate, misleading, or deceptive information through any form or communication
- Use the Website to transmit malware, viruses, or any harmful code
- Attempt to gain unauthorized access to any part of the Website, our servers, our customer data, or any related system
- Scrape, copy, mirror, or otherwise reproduce content from the Website without our prior written permission
- Use any automated means (bots, crawlers, scrapers) to access the Website except for legitimate search-engine indexing
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the operation or security of the Website
12.3 User Submissions
If you submit content to our Website (such as a review, comment, photo, or testimonial), you grant The Right Choice HVAC a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, modify, and distribute that content in connection with our business, including for marketing purposes. You represent that you have the right to submit the content and that it does not infringe the rights of any third party.
13. Intellectual Property
All content on our Website — including text, graphics, logos, photographs, videos, software, and the “The Right Choice” brand and trademarks — is owned by or licensed to The Right Choice HVAC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print pages from the Website for your personal, non-commercial use, but you may not otherwise reproduce, modify, distribute, or use any content without our prior written permission.
14. Third-Party Links and Services
Our Website may contain links to third-party websites and services (such as financing partners, review platforms, social media, and manufacturer pages). We provide these links for convenience only and do not endorse, control, or take responsibility for the content, products, services, terms, or privacy practices of any third-party site. Use of third-party sites is at your own risk and subject to their own terms.
15. Disputes, Governing Law, and Venue
15.1 Governing Law
These Terms and any dispute arising out of or relating to these Terms or any service provided by The Right Choice HVAC are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
15.2 Venue
The customer and The Right Choice HVAC agree that any lawsuit or legal proceeding shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties consent to the jurisdiction of those courts, except where Texas law specifically provides for a different venue.
15.3 Informal Resolution
Before filing any lawsuit, the parties agree to make a good-faith effort to resolve disputes informally by contacting The Right Choice HVAC at the contact information in Section 19 and allowing thirty (30) days to attempt resolution.
15.4 No Class Actions
To the maximum extent permitted by law, any disputes between the customer and The Right Choice HVAC will be resolved on an individual basis. The customer waives any right to participate in a class action, collective action, or representative action against The Right Choice HVAC.
15.5 Statute of Limitations
To the maximum extent permitted by law, any claim arising out of or relating to these Terms or our services must be brought within one (1) year of the date the claim arose, or it is permanently barred.
16. Texas Deceptive Trade Practices Act Notice
Nothing in these Terms is intended to limit or waive any rights the customer may have under the Texas Deceptive Trade Practices–Consumer Protection Act (Texas Business & Commerce Code Chapter 17) where such limitations would be unenforceable as a matter of law.
17. Force Majeure
The Right Choice HVAC is not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: acts of God, severe weather, natural disasters, fires, floods, pandemics, public-health emergencies, war, terrorism, civil unrest, government action, supply-chain disruptions, equipment shortages, utility outages, or labor disputes.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any signed Service Agreement or maintenance plan, constitute the entire agreement between the customer and The Right Choice HVAC regarding the subject matter and supersede any prior agreements or representations.
18.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties’ original intent.
18.3 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
18.4 Assignment
The customer may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. The Right Choice HVAC may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
18.5 No Agency
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between the customer and The Right Choice HVAC, except as expressly authorized for the limited purpose of obtaining permits as the customer’s agent.
18.6 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
18.7 Updates to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top indicates when these Terms were most recently revised. Material changes will be posted on our Website. Your continued use of our Website or services after the effective date of any change constitutes acceptance of the updated Terms.
